Understanding RERA in Jharkhand — What Every Property Buyer Must Know

The Real Estate (Regulation and Development) Act protects property buyers from fraud and delays. Here's how RERA works in Jharkhand and what you should verify before buying.

The Real Estate (Regulation and Development) Act, 2016 (RERA) was enacted to bring transparency, accountability, and consumer protection to India's real estate sector. Jharkhand implemented J-RERA (Jharkhand Real Estate Regulatory Authority) in 2017. Since then, it has become mandatory for all builders and developers to register their projects and comply with strict disclosure norms. Here's what every property buyer in Jharkhand must know about RERA.

What is RERA and Why Does it Matter?

Before RERA, property buyers had little legal recourse against unscrupulous builders who delayed projects for years, changed floor plans without consent, or diverted buyer funds to other projects. RERA changed the game by mandating: (1) Compulsory project registration with detailed disclosures; (2) Escrow accounts where 70% of buyer payments must be deposited and used only for that project; (3) Defined timelines with penalties for delay; (4) Buyers right to claim interest for delayed possession; (5) Fast-track dispute resolution through RERA adjudicating officers and appellate tribunal.

J-RERA Registration: How to Verify a Builder or Project

Before booking any flat, villa, or plot in a plotted development, visit the J-RERA website (rera.jharkhand.gov.in) and verify: (1) Is the builder registered with J-RERA? Check the promoter registration number. (2) Is the specific project registered? Check the project registration number and expiry date. (3) Are all mandatory disclosures uploaded? This includes land title documents, approved layout plans, completion certificate timeline, and escrow account details. If a project is not RERA-registered and the built-up area exceeds 500 sq meters OR involves 8+ apartments, it is illegal. Do not buy.

Key Buyer Rights Under RERA

Once you book a RERA-registered property, you have the following rights: (1) Right to receive possession on the date promised in the agreement (with a grace period of maximum 2 months). If delayed, the builder must pay you interest at the rate you're paying on your home loan. (2) Right to receive clear, marketable title. The builder must hand over the property with occupancy certificate and no encumbrances. (3) Right to receive the exact carpet area mentioned in the agreement. RERA mandates carpet area-based pricing, not super built-up area. (4) Right to withdraw from the project within the cooling-off period and receive a refund with interest. (5) Right to form a homebuyers' association and participate in decision-making.

How to File a RERA Complaint in Jharkhand

If your builder has violated any terms or delayed the project beyond the registered timeline, you can file a complaint with J-RERA: (1) Visit rera.jharkhand.gov.in and register as an allottee (buyer). (2) File an online complaint under Section 31 of RERA. Attach all supporting documents (agreement, payment receipts, possession date proof). (3) The RERA adjudicating officer will schedule a hearing within 60 days. Both parties present their case. (4) The officer will pass an order (typically within 60 days of the first hearing) directing the builder to pay interest, compensate, or provide possession. (5) If you're not satisfied with the order, you can appeal to the Jharkhand Real Estate Appellate Tribunal.

RERA Compliance for Real Estate Developers

As a registered developer, RC Enterprises complies fully with J-RERA regulations. All our residential and commercial projects are RERA-registered, we maintain project-wise escrow accounts, provide quarterly progress updates to buyers, and honour possession timelines. For buyers, dealing with a RERA-compliant developer like RC Enterprises eliminates the risk of fund diversion, project abandonment, and legal disputes.

What RERA Does NOT Cover

RERA applies only to projects where construction is ongoing or planned. It does NOT apply to: (1) Resale properties (individual apartments or plots being sold by the original owner). (2) Completed projects where occupancy certificate has been obtained. (3) Renovation or repair of existing buildings. For resale purchases, your protection comes from thorough title verification and a well-drafted sale deed. RC Enterprises offers title verification services for resale property buyers across Jharkhand.

Final Advice: Always Buy RERA-Registered Properties

RERA is a powerful law, but it protects you only if you buy a registered project. Never fall for "pre-launch" offers or "off-RERA" deals that promise discounts in exchange for avoiding RERA compliance. These are red flags. Insist on seeing the RERA registration certificate before paying any booking amount. At RC Enterprises, transparency is non-negotiable — we share RERA details upfront and ensure every buyer's rights are protected.
